Use of Software

Use of the Software is very important; it helps our Service run as smoothly as possible. That's why DPD makes Software available to the Customer; the Software was specially developed for DPD.

If the Customer uses the Software then DPD extends a non-exclusive, non-transferable, revocable right to use the Software. All intellectual property rights related to the Software remain with DPD or its associated companies. The Customer cannot make copies of the Software or duplicate the Software. Hardware given on loan by DPD remains the exclusive property of DPD. The Customer is responsible for correct use of the Software and any hardware that DPD makes available. DPD is not liable for any direct or indirect damage caused by the Software and/or hardware resulting from possible incorrect use of these items.

• Logo

The DPD logo is part of DPD's intellectual property. The DPD logo is protected by Benelux trademark law and by the Wipo (World Intellectual Property Organization). This means that the Customer cannot use the DPD logo in an altered form, partially or as a whole in external communication (such as folders, brochures or leaflets). The Customer cannot place it on their own website, make it public in any other form, or duplicate it. Improper use or duplication of the DPD logo in any form is a violation of intellectual property and is therefore punishable.

• Widget

An exception of the above mentioned ban is the Widget, which is made available to consumers (customer of the customer) for free. DPD grants a license to its customers; this license does not devalue DPD's exclusive intellectual property and it is limited to the operational objectives of the Widget.

• Other intellectual property

All intellectual property rights related to copyright and other texts, works, inventions, techniques, etc. that are created by or by order of DPD (in the broadest sense of the word) remain with DPD or a third-party to be appointed by DPD. For this Widget DPD grants its customers a user license, limited to its intended operational objectives and without devaluing DPD's rights within the framework of its Intellectual Property and Disclaimer.
